UDA Official Threatens State Prosecutor in Court During Kasipul MP Murder Hearing

A United Democratic Alliance (UDA) official and board member of the Lake Basin Development Authority, Ebel Ochieng Kalo, allegedly threatened to kill a State Prosecutor during a tense court session on Wednesday, prompting fresh concerns about security and witness protection in the high-profile murder case of Kasipul MP Charles Were.

Kalo, who is in custody for the April 30 murder of MP Were, reportedly uttered the chilling threat “huyu tutamuua” (we will kill him) in reference to prosecutor Allen Mulama while opposing his own bail application at the Milimani Law Courts. The incident, which took place in open court, shocked Justice Diana Kavedza and led to an immediate adjournment as Mulama exited the courtroom under security escort.

In response to the threat, Justice Kavedza denied bail for Kalo and his two co-accused and ordered that Kalo undergo a mental health evaluation at Mathari Hospital. The three suspects will remain in custody at Nairobi Remand Prison, with one held in isolation pending assessment. The case will be mentioned again on June 17, 2025.

The prosecution raised alarm over the threat, calling for urgent court intervention to ensure the safety of all parties involved in the trial. Authorities confirmed the threat would be investigated by police and addressed as a separate criminal offense.

In a related ruling, Justice Margaret Muigai ordered mental assessments for two other suspects, Isaack Kuria and Allan Omondi Ogolla, before they are formally charged with murder. Both will remain in custody at Kamiti Maximum Security Prison and have been assigned legal counsel as the court considers possible plea negotiations.

The late MP Charles Were was fatally shot at close range on April 30 at the City Mortuary roundabout in Nairobi. The assailant, riding a motorcycle, fled the scene immediately after the shooting. Among the suspects implicated are Were’s personal bodyguard, Allan Omondi, and his driver, Walter Owino. Prosecutors allege the killing was orchestrated by a criminal syndicate with links to political and security insiders.
