A petition has been filed at the Milimani Law Courts seeking to stop any potential arrest or prosecution of former Deputy President Rigathi Gachagua, amid claims of politically motivated persecution.
The petition, filed by activist George Mogire through lawyer Moses Mabeya, names the Inspector General of Police, the Director of Public Prosecutions (DPP), and the National Cohesion and Integration Commission (NCIC) as respondents. It calls for conservatory orders to protect Gachagua from what the petitioner terms "unlawful and politically charged" actions.
“The actions targeting the former Deputy President are not grounded in law but are a deliberate attempt to silence him through political persecution,” Mabeya told the court during the filing. He urged the judiciary to safeguard Gachagua’s constitutional rights, asserting that any move to detain or prosecute him would be a violation of his liberty and justice.
Gachagua, a prominent political figure and vocal critic in the national discourse, has recently been at the center of political debate, further fueling speculation about the motivations behind potential legal action against him. The petition highlights his political prominence as a factor that may have influenced recent scrutiny.
While the High Court has yet to set a hearing date for the petition, the matter is expected to generate considerable public and political interest in the coming days.
As of now, none of the named state institutions—the Office of the Inspector General, the DPP, or the NCIC—have issued formal responses to the legal challenge.
The case marks a new chapter in Kenya’s evolving political landscape, where accusations of persecution and power struggles continue to surface ahead of the 2027 general elections.
