The bail application for four suspects accused of murdering 24-year-old businessman Samwel Mugiro is scheduled for hearing on July 3, 2025. The suspects—Dennis Kiptoo Rono, Elvis Kiptanui, Abiud Barkutwa, and Cornelius Kiplimo Keter—were arraigned before Judge Emily Ominde.
During the court session, Judge Ominde addressed the bail application process, noting the practical challenges posed by having four accused persons, each represented by separate counsel seeking to make oral submissions.
“Given that the accused persons are four in number and each lawyer seeks to make oral submission on the bail application, this will not be possible as the court has other matters to attend to. The bail application shall therefore be made in writing,” ruled Judge Ominde.
The judge further directed that the bail application, which has already been filed on behalf of the second accused, Elvis Kiptanui, will be considered alongside written applications from the other accused persons. The State counsel confirmed that he has been served with the application and has also served the investigation officer and the counsel for the second accused.
Lawyers for the remaining accused have been instructed to submit their bail applications in writing within 14 days. Additionally, the court ordered that the pre-bail report be filed within the same 14-day period.
The matter will be mentioned in court on July 3, 2025, when the bail applications will be reviewed comprehensively.
The four suspects are accused of the murder of Samwel Mugiro, whose killing has shocked the local community. The court’s directive aims to streamline the bail process while ensuring all parties have adequate opportunity to present their cases in writing.
