Gachagua Files Appeal Against High Court Ruling Upholding Impeachment

Nairobi, June 23, 2026 Former Deputy President Rigathi Gachagua has formally filed a notice of appeal challenging a recent High Court decision that upheld his impeachment, signaling the beginning of another legal battle over his removal from office.
Speaking shortly after the ruling, Gachagua said he was satisfied with only a small portion of the court's lengthy 286 page judgment, arguing that several key legal and constitutional issues raised by his legal team were not adequately addressed. He indicated that his appeal would focus on what he described as critical questions regarding due process, fairness, and the interpretation of constitutional provisions governing impeachment.
"The appeal is not merely about my position but about protecting constitutional principles and ensuring that justice is served," Gachagua said.
The High Court ruling had affirmed the legality of the impeachment process, marking a significant setback for the former Deputy President. However, the filing of a notice of appeal means the matter is now set to move to the Court of Appeal, where judges will re-examine the legal arguments presented by both sides.
Political analysts say the appeal could have far-reaching implications for the country's governance and future impeachment proceedings involving senior public officials. The case is also expected to attract significant public and political interest given Gachagua's continued influence in national politics.
Supporters of the former Deputy President welcomed the decision to appeal, expressing confidence that higher courts would provide a different interpretation of the issues raised. Meanwhile, opponents argue that the High Court's judgment was comprehensive and should bring closure to the matter.
Legal experts note that filing a notice of appeal is the first procedural step and does not automatically suspend the effect of the High Court's decision. The appellate court will determine whether the former Deputy President's arguments have sufficient merit to overturn or modify the ruling.
As the legal process unfolds, attention will remain focused on the courts, where a final determination could shape the future of constitutional accountability and political leadership in Kenya.
