Court Dismisses Kangemi Hawkers’ Application as Rose Wanja Hails Ruling
The Milimani Magistrates’ Court has dismissed with costs an application filed by vendors from Kangemi market seeking the release of their alleged seized stalls and merchandise.
The applicants, led by Wycliff Nyamu on behalf of the Kangemi hawkers and Hon. Hamisi Suleiman Maleya, had moved to court under a certificate of urgency accusing Rose Wanja of allegedly orchestrating the destruction and confiscation of their stalls during an incident said to have occurred on November 23, 2025.
However, in its ruling, the court found that the applicants failed to provide sufficient evidence to prove that the respondent unlawfully seized or detained their property. The court further held that crucial material facts had not been properly placed before it to warrant the case to continue in the said court jurisdiction.
As a result, the court dismissed the application in its entirety and ordered the applicants to bear the cost of the suit.
Following the ruling, Rose Wanja welcomed the court’s decision, terming it a victory for justice and the rule of law. She maintained that the claims against her were malicious and aimed at tarnishing her name.
Reacting to the court’s decision, Rose Wanja did not mince her words, calling out what she described as an abuse of public space and legal intimidation.
> “Since when did public walkways become someone’s inheritance? Since when did bus stops start carrying people’s father’s title deeds?” Wanja posed. “You dragged me to court to ‘defend’ government land and walked out paying costs. That wasn’t justice — that was a comedy festival. You cannot own a road, you cannot own a walkway, you cannot privatize a bus stop, and you absolutely cannot bully the people of Kangemi. Public land belongs to the people, not to cartels or political bullies.”
The case had drawn public attention after the hawker claimed that his stall and merchandise were forcefully removed and allegedly taken to the Kangemi Police Station. They had sought court orders to compel the police to release the items and restrain Wanja from interfering with their businesses.
