Call for Arrest of Malala Now, Human Rights Activists Demand

A human rights lobby group, the Center for Human Rights and Democracy, has issued a strongly worded condemnation of remarks made by Cleophas Malala, calling for his immediate arrest and investigation over what it describes as “dangerous, reckless, and unsubstantiated claims” surrounding the death of the late Emurua Dikir Member of Parliament, Johanna Ngeno.
In a detailed statement released on Friday, the organization expressed deep concern over what it termed as a growing trend among political leaders to weaponize public platforms to spread misinformation, incite division, and undermine national unity. The group warned that Malala’s allegations—particularly those linking the death of the late MP to political actors including Samson Cherargei—were not only baseless but also highly inflammatory.
According to the activists, such statements have the potential to destabilize the country, especially in regions with a history of political and ethnic sensitivities. They noted that the claims risk deepening divisions within the Kalenjin community, particularly between the Kipsigis and Nandi sub-groups, thereby threatening social cohesion in the Rift Valley.
“This is not just careless talk—it is dangerous warmongering disguised as political expression,” the statement read. “We are staring at a situation where irresponsible utterances by leaders can easily ignite tensions and push communities toward conflict.”
The group further criticized what it described as a worrying silence and inaction from key state institutions mandated to safeguard law and order. It called out the offices of the Inspector General of Police, the Directorate of Criminal Investigations (DCI), the Office of the Director of Public Prosecutions (ODPP), and the Ministry of Interior, accusing them of failing to act decisively in the face of rising incitement and misinformation.
“We are putting these institutions on notice. They must wake up from slumber and execute their constitutional mandates,” the statement emphasized. “The continued inaction sends a dangerous message that individuals can make reckless and potentially explosive claims without consequence.”
The activists warned that Kenya risks sliding into a state of lawlessness if such behavior is allowed to persist unchecked. They argued that the country cannot afford to normalize a culture where political leaders openly make allegations that threaten national security without being held accountable.
“We cannot become a gang-like nation where the rule of law is optional and enforcement is selective,” the statement continued. “The security apparatus is fully funded and constitutionally empowered to act. Failure to do so amounts to negligence of duty.”
In its analysis, the Center for Human Rights and Democracy outlined several risks associated with the spread of misinformation and inflammatory political rhetoric. Among the most pressing concerns is the potential for social unrest, as false narratives can quickly inflame ethnic and political tensions, leading to unrest and possible violence.
The group also highlighted the danger of insurgency and localized violence, noting that sensational and unverified claims can create an environment where lawlessness thrives. “When leaders speak irresponsibly, they legitimize chaos and embolden those who may wish to exploit the situation for violent ends,” the statement noted.
Additionally, the activists warned of the gradual erosion of public trust in institutions. They argued that repeated attacks and unverified accusations against state agencies can create confusion, weaken confidence in governance structures, and ultimately undermine the rule of law.
Political instability was also cited as a major risk, particularly as the country approaches sensitive political periods. The group cautioned that misinformation during such times can heighten tensions, fuel hostility, and disrupt democratic processes.
The statement further introduced the concept of “cognitive warfare,” warning that the rapid spread of false information—especially through social media—can manipulate public perception, trigger emotional reactions, and create widespread fear, panic, and hopelessness.
“This is a new frontier of conflict where the battle is for the minds of citizens,” the activists explained. “If not addressed, it can be as destructive as physical violence.”
The organization also raised concerns over remarks allegedly made by former Deputy President Rigathi Gachagua, suggesting that a pattern is emerging where senior political figures engage in rhetoric that undermines national stability. It warned that such conduct, if left unchecked, could normalize impunity and weaken democratic governance.
In light of these concerns, the group issued a series of demands to the government. Chief among them is the immediate summoning of Cleophas Malala by investigative authorities to record a statement regarding his claims. The activists insisted that due process must be followed, but emphasized that the seriousness of the allegations warrants urgent legal scrutiny.
“We demand that Malala be held accountable in accordance with the law. No individual, regardless of political standing, is above the law,” the statement declared.
The group also called on President William Ruto to take decisive action and provide leadership in addressing what it described as a growing threat to national cohesion. It urged the Head of State to ensure that institutions tasked with maintaining law and order operate independently, efficiently, and without political interference.
Furthermore, the activists warned that continued inaction by public office holders could attract consequences, both legally and in terms of public accountability. They urged those unable or unwilling to fulfill their mandates to step aside.
“The offices charged with maintaining security, law, and judicial integrity must act decisively or take the honorable path and resign,” the statement said.
As the nation continues to mourn the late Johanna Ngeno—whom the group described as a “brilliant, energetic, and forthright leader”—the activists called for restraint, responsibility, and respect in public discourse. They emphasized that the circumstances surrounding his death should be handled with dignity and professionalism, free from political manipulation.
“Let investigations be conducted transparently and professionally. Speculation and propaganda have no place in matters of life and death,” the statement urged.
The Center concluded by reaffirming its commitment to defending human rights, democracy, and the rule of law. It stressed that constitutional freedoms must be exercised responsibly and should never be used as a shield for incitement or the spread of harmful falsehoods.
“Human rights and democracy are not synonymous with disorder or impunity,” the statement concluded. “They demand a higher standard of civic responsibility, accountability, and unwavering respect for the rule of law. Kenya must remain a nation governed by law, not by reckless rhetoric.”
