Former Chief Justice David Maraga Criticises Governor Kahiga Over Remarks on Raila Odinga’s Death

Former Chief Justice David Maraga has criticised Nyeri Governor Mutahi Kahiga over controversial remarks he made following the death of former Prime Minister Raila Odinga.

Speaking at a funeral yesterday, Governor Kahiga suggested that Raila’s death was a form of divine intervention meant to unlock development in certain regions of the country. His comments, made while the nation was still mourning the passing of the opposition leader, sparked widespread outrage.

Leaders from various political affiliations condemned Kahiga’s remarks as insensitive and disrespectful, while Kenyans on social media expressed their disapproval, emphasising Raila’s legacy as a statesman who championed devolution and national unity.

Raila Odinga was widely recognised for his pivotal role in the 2010 constitutional reforms, his commitment to peace through the “handshake” after contested elections, and his efforts to promote equitable development and democratic governance — earning him respect across the political divide.

In response to Governor Kahiga’s remarks, Maraga issued a statement invoking Article 73(1) of the Constitution of Kenya, which outlines the responsibilities of state officers.

“As a campaign guided by the Ukatiba philosophy, we remind Governor Mutahi Kahiga that Article 73(1) requires a state officer to demonstrate respect for the people, bring honour to the nation, and uphold the dignity of the office,” Maraga stated.

He further described Kahiga’s comments as abhorrent and a violation of the very Constitution that Raila helped bring to life. Maraga urged accountability from public officials who fail to uphold constitutional values.

“The governor’s remarks are abhorrent and should not only be treated with the contempt they deserve; he should also be reminded that these remarks amount to a violation of the Constitution of Kenya, 2010,” he added.
